Terms of Use

These Terms of Use ("Terms") govern your access to and use of creativityteam.org (the "Site"), operated by Joal Henke's Creativity Team at Keller Williams Realty, Greater Downtown ("Creativity Team," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By browsing, searching, submitting a form on, or otherwise using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. We may update these Terms from time to time as described in Section 13. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use in connection with evaluating our real estate services. You may not copy, reproduce, republish, frame, scrape, data-mine, or create derivative works from any part of the Site without our prior written permission, except as necessary to view pages normally through a standard web browser.

3. Real Estate Listing Information

Property listing information on the Site, including data displayed through an Internet Data Exchange ("IDX") feed where applicable, is sourced in whole or in part from the local Multiple Listing Service ("MLS"). This information is believed to be reliable but is not guaranteed and is subject to change without notice, including price, availability, and status. Some listings on the Site may be represented by brokerages other than Keller Williams Realty, Greater Downtown, as required by MLS/IDX display rules. Square footage, lot size, school assignments, and other property details are approximate and should be independently verified before you rely on them, including through your own inspection, appraisal, and the applicable school district. Nothing on the Site constitutes an offer to sell or a solicitation of an offer to buy real estate in any jurisdiction where we are not licensed to do so.

4. No Professional Advice

Content on the Site, including area guides, FAQs, monthly market updates, and any AI-assisted content described in our Privacy Policy, is provided for general informational purposes only. It is not legal, tax, financial, engineering, or other professional advice specific to your situation, and it should not be relied upon as such. Always consult a qualified professional, such as an attorney, accountant, lender, or inspector, before making a real estate or financial decision.

MLS-sourced content, including listing photographs and data, remains the property of the applicable MLS and its participants. You may not use our name, logo, or brand elements without our prior written consent.

7. Third-Party Links and Content

The Site may include links to, or embed content from, third-party services such as Zillow, Homes.com, Google, and Instagram. We do not control and are not responsible for the content, accuracy, or privacy practices of any third-party site or embedded content. Your interactions with those third parties are governed by their own terms and privacy policies.

8. User Conduct

You agree not to use the Site to violate any applicable law; impersonate any person or entity; interfere with or disrupt the Site's operation or security; introduce viruses or other malicious code; or scrape, harvest, or collect information about other visitors without their consent.

9. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any listing information is complete or current.

10. Limitation of Liability

To the fullest extent permitted by law, Creativity Team, Keller Williams Realty, Greater Downtown, and their respective agents and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Creativity Team, Keller Williams Realty, Greater Downtown, and their respective agents and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Hamilton County, Tennessee, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may revise these Terms at any time by updating the date at the top of this page and posting the revised Terms on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
